What Is A Secondary Dwelling?
A secondary dwelling is a separate living unit located on the same property as a primary residence. These are typically used for accommodating extended family, guests or renters and can be self-contained or share facilities with the main dwelling.
Obtaining Approval
Before renting out your granny flat, it’s essential that you obtain all relevant approvals, including development/building and council approvals. You’ll also need to ensure that the dwelling complies with health and safety regulations, such as smoke alarm requirements.
Tenancy Agreement
The next step is to finalise a tenancy agreement. The type of agreement (i.e., general tenancy agreement or rooming accommodation agreement) will depend on the set up of the property. Other important things to note include:
- The main property address should be listed on the tenancy agreement
- The agreement should clearly outline & describe the space being rented
- The agreement should list both parties’ agreement on other relevant matters, like parking, mail management, property access, utilities & gardening
Utilities
The property owner and tenant should negotiate how all utilities will be managed and paid. The tenancy agreement must state:
- What service/s the tenant is being charged for
- How the tenant’s share of the bill will be worked out
- How the tenant should pay for the charges

Before renting out your secondary dwelling, consider whether to install a new mailbox or come to an agreement with the tenant about how mail will be managed. To add a new mailbox, you’ll need to consult with your local council, as they are the recognised authority for allocation and approval of numbering.
Garden Maintenance
If the primary and secondary dwellings share a garden, the property owner and tenant will need to come to an agreement regarding upkeep and maintenance. Be detailed and specific to avoid confusion or disputes, including areas of the garden each party is responsible for and who supplies equipment.
